Terms of Service

MasseurAI is a digital directory and AI-enhanced matching platform that connects individuals seeking massage services ("Clients") with independent massage professionals ("Professionals").

MasseurAI does not employ, manage, supervise, or control any Professional.

Professionals listed on the Platform are independent contractors responsible for their own conduct, advertising, legal compliance, and service delivery.

MasseurAI/BAK Media Inc. is not a massage establishment and does not provide massage, spa, or therapeutic services of any kind.

Your use of the Platform is at your own risk. You are responsible for evaluating the suitability, qualifications, certifications, and safety of any Professional you choose to interact with.

To use MasseurAI, you must:

• Be 18 years of age or older
• Have legal capacity to enter a binding agreement
• Provide accurate and truthful information when creating an account or interacting with the Platform

You may not use the Platform if you have been previously suspended or banned.

Creating an account allows access to additional features including AI tools, messaging, and verification tiers.

By registering, you agree:

• You are responsible for maintaining the confidentiality of your login credentials.
• You will not create an account on behalf of someone else without authorization.
• You will not share or sell your account.
• You will notify MasseurAI immediately of unauthorized access or security concerns.
• MasseurAI may suspend or terminate your account for violations, fraudulent activity, or misuse of any kind.

• All services occur directly between Clients and Professionals.
• MasseurAI does not supervise sessions, background check every Professional, or guarantee quality.
• MasseurAI does not dictate service pricing, session length, or modalities offered by Professionals. Our optional SmartRate tool generates suggested rates based on market data, but Professionals set their final prices and may accept or ignore any suggestion.
• Professionals agree to conduct themselves lawfully, ethically, and professionally. However, MasseurAI is not responsible for enforcing or monitoring such conduct.

Nothing on the Platform shall be interpreted as medical advice, therapeutic instruction, or health diagnosis.

Professionals may subscribe to Starter, Professional, or Elite tiers offering various promotional and visibility tools.

• Subscription fees are billed monthly and automatically renew, unless cancelled by user.
• Fees are non-refundable for the active billing period (unless required by law).
• There are no commissions, revenue share agreements, or booking fees collected by MasseurAI.
• MasseurAI may update pricing, features, or membership benefits with reasonable notice.

Professionals are solely responsible for their taxes, business licensing, and regulatory compliance.

Payments are made directly between the Client and the Professional, using payment methods the Professional accepts.

• MasseurAI does not process payments, hold client funds, or act as an intermediary.
• Scheduling, cancellations, refunds, disputes, and service details are governed exclusively by the Professional's own policies.

Open Offers. Clients may post a same-day "Open Offer" describing the session they want (city, duration, budget, and session type). Open Offers are non-binding requests broadcast to nearby Professionals; acceptance is entirely at a Professional's discretion and MasseurAI does not guarantee a match, response, or availability.

Discretion Mode. Clients may enable Discretion Mode on a booking, which hides the client's last name and automatically deletes the booking record approximately 72 hours after the session. MasseurAI is not liable for any data lost through this user-selected auto-deletion.

MasseurAI is not responsible for disputes arising from bookings or payments.

MasseurAI provides optional AI-assisted features, including:

• Comfort Intelligence™ (environment & style preferences)
• AI Compatibility Match™ (preference-based pairing suggestions)
• Aftercare AI™
• Body Positivity & Fair Visibility AI™
• Discovery Filters & Personalized Sorting Algorithms

Trust & Visibility Scores. MasseurAI computes algorithmic Trust and Visibility scores from profile completeness, verification level, booking activity, review quality, and similar signals. These scores influence how and where Professionals appear in the directory and may change over time; they are guides, not guarantees of ranking or performance.

Third-Party Integrations. Professionals who link external accounts (e.g., Google Calendar for availability sync) do so under those providers' own terms and privacy policies. MasseurAI stores only the access needed to power the integration and does not control third-party services.

Professionals and Clients may participate in optional verification tiers.

MasseurAI may request:

• Mobile phone verification
• Government-issued ID
• Professional certifications or licenses

Verification materials are used solely for safety, fraud prevention, identity confirmation, and account integrity. They are encrypted, securely stored, and never sold to third parties.

Passing verification does not guarantee accuracy, professional competence, or legal compliance.

MasseurAI reserves the right to deny or revoke verification at its sole discretion.

You agree not to use the Platform to:

• Post false, misleading, harassing, explicit, or defamatory content
• Engage in escorting, sexual services, or any illegal activity
• Request or offer services that violate local, state, or federal laws
• Impersonate another person or misrepresent your identity or credentials
• Interfere with or disrupt Platform security, data, or infrastructure

MasseurAI may remove content or terminate accounts that violate these standards.

All Platform content—including branding, software, design elements, AI tools, algorithms, trademarks, and logos—is the property of BAK Media Inc.

You may not:

• Copy, reproduce, modify, or distribute content
• Use MasseurAI trademarks without permission
• Scrape or extract data from the Platform

You assume full responsibility for evaluating risks when interacting with any Professional.

To the fullest extent permitted by law, BAK Media Inc. is not liable for:

• Any damages arising from interactions between Clients and Professionals
• Personal injury, property damage, misconduct, negligence, or illegal acts by Professionals
• Loss of profits, data, goodwill, or business interruption
• Unauthorized access to your account or data beyond our reasonable control

Total liability shall not exceed:

• USD $100, or
• The amount you paid to MasseurAI in the last 12 months (whichever is greater).

You agree to indemnify and hold harmless BAK Media Inc. and its officers, employees, and affiliates from claims arising from:

• Your use of the Platform
• Your violation of these Terms
• Your interactions with Professionals or Clients
• Content you provide or publish

MasseurAI encourages safe-practice standards but does not guarantee user behavior.

Clients and Professionals are responsible for:

• Conducting due diligence
• Maintaining professional boundaries
• Complying with all local laws, massage regulations, and ethical guidelines

Any inappropriate, illegal, or unsafe behavior should be reported immediately to support@masseurai.com.

You may delete your account at any time.

MasseurAI may suspend or terminate your account if you:

• Violate these Terms
• Engage in fraud, misconduct, or unsafe behavior
• Misuse the Platform or attempt unauthorized access

Upon termination, your right to use the Platform immediately ends.

These Terms are governed by the laws of the State of Florida, without regard to conflict of law provisions.

All legal disputes shall be brought exclusively in Miami-Dade County, Florida.

Before filing a claim, you agree to contact support@masseurai.com to attempt resolution.

If unresolved, disputes will be resolved through binding arbitration conducted by the American Arbitration Association (AAA) in Miami, Florida.

We may modify these Terms at any time. Updates will be posted with a revised "Effective Date."

Continued use of the Platform constitutes acceptance of the updated Terms.
